   IMPORTANT UPDATE ON FAA REQUIREMENTS FOR DRUG & ALCOHOL TESTING
 
 
Recently the FAA provided a new Drug & Alcohol Compliance and Enforcement Inspector Handbook for FAA personnel to follow when investigating the drug and alcohol testing programs of aviation industry employers and contractors.  This indicates that inspections and audits are on the increase.

At a minimum, each inspection will include a review of mandatory testing records (i.e., pre-employment and random testing; positive drug tests, alcohol violations, and refusals) and the records specified in 49 CFR § 40.25.  In addition, training and education records will be examined – training for supervisors is required, training for employees is required, and there is also a requirement for “Information Material to be Displayed and Distributed to Employees.”

MORE  ON FAA CONTRACTOR REQUIRMENTS

On January 10, 2006, the Federal Aviation Administration (FAA) issued a final rule amending the drug and alcohol testing regulations in 14 CFR Part 121, Appendix I and J. The rule went into effect on October 10, 2006, and had a significant impact on the aviation maintenance industry.

The amended rule requires that each employee who performs a safety-sensitive function (i.e., maintenance) for an air carrier, by contract or subcontract at any tier, must be tested under an FAA-regulated drug and alcohol testing program.

A certified repair station under Federal Aviation Regulation (FAR) Part 145 must maintain and provide upon request to your Air Carrier Contractors.
